These Terms & Conditions (“Terms”) govern your access to and use of the Foxwriters website and the ghostwriting, book writing, eBook writing, editing and proofreading, book design, publishing, and marketing services we provide (together, the “Services”). By using our website or engaging our Services, you agree to these Terms. If you do not agree, please do not use our website or Services.

1. Our services

Service descriptions, packages, and examples on this website are for general information. The exact scope, deliverables, timelines, and fees for your project are set out in a written proposal, quote, or project agreement (“Project Agreement”). If anything in a Project Agreement conflicts with these Terms, the Project Agreement takes priority for that project.

2. Eligibility

You must be at least 18 years old, or have the consent and involvement of a parent or legal guardian, to engage our Services. By placing an order, you confirm that the information you provide is accurate and that you have the authority to enter into this agreement.

3. Project process and your responsibilities

Great books are built together. To keep your project on schedule, you agree to:

• provide the information, materials, interviews, and feedback we reasonably need in a timely manner;
• review drafts and respond to questions within the timeframes agreed in your Project Agreement;
• make sure any materials you provide (text, images, quotes, trademarks) are yours or that you have permission to use them; and
• share accurate facts, names, and details, particularly for memoirs, biographies, and non-fiction.

Delivery dates are estimates and depend on timely client input. Delays in feedback or materials may extend the project timeline. If a project is inactive for more than 60 days due to lack of client response, we may pause it and schedule a restart based on team availability.

4. Payments

• Fees and payment schedules are stated in your Project Agreement. Most projects require an upfront deposit before work begins, with remaining payments tied to milestones.
• Work on the next milestone begins once the related payment is received. Final files are released after full payment.
• Prices are quoted in U.S. dollars unless stated otherwise. You are responsible for any bank, currency conversion, or transaction fees.
• Third-party costs, such as ISBNs, copyright registration, printing, distribution, advertising spend, or stock images, are not included unless listed in your Project Agreement.

5. Revisions

Each package includes the number of revision rounds stated in your Project Agreement. A revision means changes to delivered work within the agreed scope. Requests that change the project’s direction, structure, length, or scope after approval may be treated as new work and quoted separately.

6. Cancellations and refunds

• You may cancel a project at any time by giving written notice to support@foxwriters.com.
• If you cancel before any work has started, you may be eligible for a refund of your deposit, minus any administrative or third-party costs already incurred.
• Once work has started, fees for completed milestones and work in progress are non-refundable. Any refund of prepaid amounts for work not yet started will be calculated as described in your Project Agreement.
• Refunds are not provided on the basis of book sales, reviews, awards, or acceptance by publishers, agents, or retailers, since these are outside our control.

7. Ownership and intellectual property

Your book

Once you have paid in full, you own all rights, title, and interest in the final manuscript and deliverables created for you, including the copyright. For ghostwriting projects, you may publish the work under your own name, and Foxwriters will not claim authorship or credit. Until full payment is received, all rights in the work in progress remain with Foxwriters.

Your materials

You keep ownership of all materials you provide to us. You grant us a limited license to use them only to deliver the Services.

Our website

The content, text, graphics, logos, branding, and design of this website are owned by Foxwriters or its licensors and are protected by intellectual property laws. You may not copy, reproduce, or distribute them without our written permission.

8. Confidentiality

We keep your ideas, manuscripts, and personal details confidential and use them only to complete your project. Our team members are bound by confidentiality obligations, and we are happy to sign a non-disclosure agreement on request. For more detail, see our Privacy Policy.

9. Content standards

We reserve the right to decline or stop work on any project that we reasonably believe is unlawful, defamatory, hateful, infringes someone else’s rights, or conflicts with our values. You are responsible for the final content you approve and publish, including the accuracy of facts and statements about real people. We recommend a legal review for memoirs and non-fiction that discuss identifiable individuals.

10. Publishing and marketing results

We will use our professional skills and best efforts in every project. However, we do not guarantee book sales, rankings, reviews, royalties, media coverage, awards, or acceptance by any literary agent, publisher, or retail platform. Publishing platforms set their own rules and may approve, reject, or remove content at their discretion.

11. Third-party services

Some Services rely on third parties such as online retailers, printers, distributors, and advertising platforms. Their terms and fees apply, and we are not responsible for their actions, policies, or outages.

12. Disclaimer

Our website and its content are provided “as is” and “as available” for general information. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in a Project Agreement.

13. Limitation of liability

To the fullest extent permitted by law, Foxwriters will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Services will not exceed the total amount you paid us for the specific project giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Foxwriters and its team from any claims, losses, or expenses (including reasonable legal fees) arising from materials you provide, content you approve or publish, or your breach of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. We encourage you to contact us first so we can try to resolve any concern informally. If a dispute cannot be resolved within 30 days, it will be handled exclusively by the state or federal courts located in Harris County, Texas.

16. Changes to these terms

We may update these Terms from time to time. Any changes will be posted on this page. Updated Terms apply to new projects and to your continued use of the website after they are posted. Existing Project Agreements remain governed by the terms in place when they were signed unless both parties agree otherwise.
